First Choice Women’s Resource Centers, Inc. v. Platkin
On August 28, 2025, the Robertson Center filed a merits stage amicus brief in First Choice Women’s Resource Centers, Inc. v. Platkin. The Center’s brief supports the Petitioner, First Choice Women’s Resource Centers, Inc., a group of crisis pregnancy centers in New Jersey. In this case, the New Jersey Attorney General targeted First Choice with a harassing investigation based on the unfounded suspicion that First Choice may be involved in fraudulent conduct because donors may have been “confused” because First Choice does not perform abortions.
Despite not receiving a single complaint about First Choice, the Attorney General issued a sweeping subpoena demanding the names, phone numbers, and addresses of First Choice’s donors. This was on top of partnering with Planned Parenthood to issue a consumer alert targeting pregnancy centers state-wide.
The Center’s brief focuses on a jurisdictional issue and incorporates material from Regent Professor Christian Edmond’s law review article: Christian Edmonds, Prudential Ripeness and the Federal Forum Guarantee, 2025 U. Ill. L. Rev. Online (Oct. 2025).
A decision is expected from the Supreme Court by the end of June 2026.
