Dobbs v. Jackson Women’s Health Organization

Court: Supreme Court of the United States, No. 19-1392
Case status: Resolved in favor of the petitioner, the state of Mississippi
Center involvement: Amicus Curiae
Date of filing: July 28, 2021

In Dobbs v. Jackson Women’s Health Organization, the Supreme Court overruled Roe v. Wade and Planned Parenthood v. Casey, making Dobbs the most significant abortion-related case in a generation. The brief of the Robertson Center for Constitutional Law and the Christian Legal Society argued for a return to our constitutional tradition of federalism and explains how open-ended conceptions of substantive due process undermine the fundamental principles of federalism and self-government. It also explains how abortion jurisprudence has had far-reaching negative consequences, especially for our judicial institutions.
