Regino v. Blake

Court: United States Court of Appeals for the Ninth Circuit: No. 26-475581
Case Status: Ongoing
Center Involvement: Amicus Curiae Brief
Date of Filing: March 13, 2026

The Roberston Center filed an amicus brief on behalf of Professors S. Ernie Walton and Eric A. Degroff in Regino v. Blake. The case involves a school policy that calls for schools to socially transition children upon their request without parental consent and, in most cases, without parental notice. Ms. Regino, whose daughter was transitioned, without Ms. Regino’s knowledge, filed suit arguing that parents have the right to consent—or at least to notice—when the state seeks to socially transition their children at school.

Our brief highlights the parental rights scholarship of Regent Law Professors Walton and DeGroff, demonstrating that parents’ historical right to direct the upbringing of their children and the limits of a school’s authority to hide information from the parents about important moral and religious matters.
